1. Introduction

This end user agreement (“agreement” or “terms”) should be read by you (the “user”) in its entirety prior to your use of this website. Please note that this agreement constitutes a legally binding agreement between you and sole proprietor Oleksandr Liaposhchenko (registered and established under the laws of Ukraine) (“us” or “we”) [which/who] owns and operates the Internet site found and product described at https://www.masker.at (“website” or “service”). By using the service, you consent to all terms and conditions set forth in this agreement.

2. Access to the website

It is your responsibility to ensure your computer system meets all the necessary technical specifications to enable you to access and use the website and is compatible with the website. If you breach or violate these terms in whole or in part any provision contained herein, we reserve the right to take such action as we see fit, including but not limited to terminating this agreement or any other agreement in place and/or preventing you from future use of the website. Any such decisions and/or actions taken by us are final and shall not be open for review or appeal. If you do not or cannot agree to all terms in this agreement, do not use the service.

3. Modifications

We reserve the right to make updates, modifications and amendments to this agreement and/or change the website and/or service at any time and for any reason without formal notice or notification. Your continued use of the service means that you agree to any and all of these changes.

4. Copyright

The source code of the service is protected solely by the license found at https://raw.githubusercontent.com/masker-at/app/main/LICENSE . Other parts of the service, including the name “Masker@”, the Masker@ logo, its domain names masker.at, subdomains www.masker.at and app.masker.at, trade marks, service marks and other marks of intellectual ownership (“trademarks”); all content on the website, including but not limited to images, pictures, graphics, photographs, animations, videos, music, audio and text (the “website content”) used by us as part of the service are protected by copyright, other intellectual property and/or other rights and remain the strict and sole property of the software owners under license to us. By using the service, you obtain no rights to and may not under any circumstances copy, distribute, publish, reverse engineer, decompile, dissemble, modify or translate any part of the website content or trademarks. Additionally, you agree not to harm our rights or intellectual property rights and the rights of software owners.

5. No warranties

Your use of the service is at your sole option, discretion and risk. The service provided is on an “as is” and “as available” basis and we disclaim any and all warranties, expressed or implied in connection with the service. We make no warranty or representation regarding service quality, fitness for purpose, completeness or accuracy. We make no warranty or representation that the service will be uninterrupted, timely, error-free or that defects will be corrected.

We may change the format and content of the website from time to time. Whilst we try to make sure that all information contained on the website (other than any user-generated content) is correct, it is not intended to amount to authority or advice on which reliance should be placed. You should check with us or the relevant information source before acting on any such information.

6. Signing up

You will be required to submit a valid email address and a password (“login details”) to use the service for the first time, thereby registering a new account (“your account”). Additionally, to use the service, you will need to prove that the email address you provided belongs to you (“verify your email address”) by receiving an email from Masker@ and engaging with the link contained in it.

7. Security of your data and your account

After you register your account, your email address and password will be transferred to our servers with encryption and securely stored to verify your subsequent logins to the website. In order to access your account in future, you will be required to enter your login details. It is your sole and exclusive responsibility to ensure that your login details are kept confidential and ensure your account cannot be accessed by other users. You shall not disclose your login details to anyone or provide access to your account to any third party, including but not limited to minors. You are responsible for any actions done with your account on the website. We are not responsible for any abuse or misuse of your account due to your disclosure, whether intentional or accidental, whether active or passive, of your login details to any third party.

8. Access to the products and services

In order to use the digital products and services provided on the website (the “product”), you need to register your account and verify your email address according to part 5 of this agreement. During the first 7 days (“free trial period”) after registering your account, you will be able to use the product for free. After the free trial period you will be required to purchase a subscription through the website to continue using the product for a certain amount of time according to the pricing information listed on the website.

All purchase fees shall be due and payable immediately. If you don’t make a purchase after your free trial period or subscription ends, your account will be considered paused. We reserve the right to terminate your account if it has been paused for 90 days.

9. Privacy policy

Our use of your personal data submitted to or via the website is regulated by the Privacy Policy.
